Article 1 - Principles

These general conditions express the entirety of the obligations of the parties. In this sense, the buyer is deemed to accept them without reservation.

These general conditions of sale apply to the exclusion of all other conditions, and in particular those applicable to sales in stores or through other distribution and marketing channels.

They are accessible on the website Maguilej and shall prevail, where applicable, over any other contradictory version or document.

The seller and the buyer agree that these terms and conditions exclusively govern their relationship.
The seller reserves the right to modify these terms and conditions from time to time. They will be applicable as soon as they are published online.

If a condition of sale were to be lacking, it would be considered to be governed by the practices in force in the distance selling sector whose companies have their headquarters in France.

 

Article 2 - Content

These general terms and conditions define the rights and obligations of the parties in the context of the online sale of goods offered by the seller to the buyer, via the website. Maguilej.

These terms and conditions apply only to purchases made on the website of Maguilej.

These purchases concern the following products: Handmade costume jewelry.

 

Article 3 - Pre-contractual information

The buyer acknowledges having received, prior to placing their order and concluding the contract, in a legible and understandable manner, these general terms and conditions of sale and all the information listed in article L.221-5 of the Consumer Code.

The following information is transmitted to the buyer in a clear and understandable manner:

  • the essential characteristics of the property;

  • the price of the item and/or the method of calculating the price;

  • any additional costs;

  • the delivery date or timeframe;

  • information relating to the identity of the seller, their electronic contact details, legal guarantees and other contractual conditions.

 

Article 4 - The order

The buyer has the option to place their order online from the online catalogue, subject to available stock.

The buyer will be informed of any unavailability of the ordered product.

For the order to be validated, the buyer must accept these terms and conditions, choose the delivery address and method, and then validate the payment method.

The sale will be considered final:

  • after sending an order confirmation email;

  • after receipt of the full price.

All orders imply acceptance of the prices and descriptions of the products.

The seller reserves the right to block the order in case of payment problems or incorrect information.

Article 5 - Electronic signature

Providing bank details online and validating the order constitutes proof of the buyer's agreement.

In the event of fraudulent use of a bank card, the buyer is asked to contact the seller at contact@maguilej.com.

 

Article 6 - Order confirmation

The seller provides the buyer with an order confirmation via email.

 

Article 7 - Proof of the transaction

The computerized records kept in the seller's systems constitute proof of communications, orders and payments.

 

Article 8 - Product information

The products are those listed on the website Maguilej, while stocks last.

The descriptions are as accurate as possible. The photographs are not contractual.

 

Article 9 - Price

Prices are shown in euros, excluding delivery charges.

The seller reserves the right to change its prices at any time but applies those in effect at the time of the order.

Prices include VAT applicable on the day of the order.

 

Article 10 - Method of payment

Placing an order implies an obligation to pay.

Accepted payment methods:

  • Bank card

  • PayPal

Payment is due in full on the day the order is placed.

 

Article 11 - Availability – Refund – Resolution

Shipping times are 1 8 business days, 30 for personalized necklaces.

In case of delay, the buyer may request the execution or termination of the contract.

In case of unavailability, the buyer may request a refund or an exchange.

 

Article 12 - Terms of delivery

Delivery is made to the address provided by the buyer.

In case of an address error, the buyer is responsible for the reshipping costs.

The buyer must check the condition of the package upon receipt and report any anomalies within 48 hours.

 

Article 13 - Delivery errors

Any claim must be made no later than 48 hours after delivery to contact@maguilej.com

Return costs are the responsibility of the buyer.

 

Article 14 - Product warranty

14-1 Legal guarantee of conformity

In accordance with the articles L.217-3 et seq. of the Consumer Code.

14-2 Warranty against hidden defects

In accordance with Articles 1641 et seq. of the Civil Code.

 

Article 15 - Right of withdrawal

The buyer has a period of 14 days from the date of receipt to exercise their right of withdrawal.

Return costs are the responsibility of the buyer.

Personalized products are not affected.

 

Article 16 - Force majeure

Neither party shall be held liable in the event of force majeure as defined by French case law.

 

Article 17 - Intellectual property

All site content Maguilej are protected by intellectual property law.

 

Article 18 - Data Processing and Freedoms

Personal data is necessary for order processing.

The buyer has the right to access, rectify and object.

 

Article 19 - Partial non-validation

The invalidity of one clause does not render the other clauses invalid.

 

Article 20 - Non-waiver

The failure to invoke a breach does not constitute a waiver for the future.

 

Article 21 - Titles

The securities have no contractual value.

 

Article 22 - Language of the contract

These Terms and Conditions are written in French. Only this version is legally binding.

 

Article 23 - Mediation and settlement of disputes

The buyer may resort to mediation or the European online dispute resolution platform.

 

Article 24 - Loi applicable

These general terms and conditions are subject to French law.
In the event of a dispute, an amicable solution will be sought before any legal action is taken.
